This is not an accusation - it is merely a question.
Actually, that's a perfectly legitimate question, given that if a charge of fraud were ever to be brought in an American criminal court the level of evidence would need to clear the bar of "beyond a reasonable doubt", requiring that jurors be "firmly convinced" of guilt based on reason and common sense, leaving no reasonable alternative explanation [per Cornell Law School's Legal Information Institute].

So your specific question, "can anyone provide a remotely possible conclusion … other than intentional deceit and fraudulent business activities" is exactly what a court would look to the defense attorney to answer.

Scott, do an AI search of Apache Labs! The one I used actually noted these problems!!! Obviously, the AI has collected reports from numerous sources … in order to accurately note the problems!

I am sure the money stream of deposits has been affected (I’ve heard from perhaps 10 who got a refund through their Credit Card Co. or Bank.) I encourage anyone waiting more than 30 days past the window of time in which they were promised delivery - to file a claim. For those like me, it’s too late.

I AM CONSIDERING PUTTING TOGETHER A LIST OF CUSTOMERS WHO HAVE NOT RECEIVED THEIR ORDER!

I have no desire to undertake this task, but it appears that someone needs to. IF … IF I do this, the information would not include a public way of identifying individuals; the goal would be to track the PRODUCTS NOT DELIVERED, THE AMOUNT PAID, DURATION OF THE WAIT, etc. Perhaps Scott could make room for such a topic or a pinned area of some type. BUT BEFORE EXPENDING THE EFFORT, I WOULD NEED TO KNOW THAT THE COMMUNITY IS ONBOARD … THAT THERE ARE THOSE WHO ARE WILLING TO COME FORTH … AND THAT YOU WILL HELP ME PURSUE OTHERS. The best way to start from a forum perspective is to create a new topic in the "Sales, Delivery, Warranty & Repair Discussions" sub-forum: viewforum.php?f=43 I will be happy to "tack" the topic to the top of the list.

I'd recommend that in the first post you provide directions for how submissions can be made to you privately via PM or email, but people are welcome to post publicly if they don't care.

It's also important to include an appropriate statement about folks keeping editorial comments respectful and fact-based. I really don't want to have to be the bad guy and do a lot of moderation! Any comments about "That so and so" or "He's a such and such" are not going to be allowed. People need to keep it factual. The list will speak for itself.

By using the "edit" feature of the Forum, you can update the list in Post #1 as it develops. Ongoing discussion can be performed at the bottom of the thread in new posts in a normal fashion, of course.

You might also want to solicit the community for assistance in this matter. It need not be a one person job.

imo, ideally you would do this somewhere which is not on a platform that is owned by ApacheLabs, and as such would be immune to their intervention. Just something to consider.

Someone can remain semi-anonymous by using Private Messages to David or whoever accepts the task and a running tally be posted. I would suggest screenshots be made of PMs for backup and verification reason in case the tally count is ever questioned. I don't think ever Anan user visits here, Facebook, or Discord but it does need to be located in one place and one place only. Posts can be made in other places like DIscord, Facebook, QRZ directing people to here and they can either list their details publicly in the post or privately to whoever is in charge of adding to the count.

The platform (forum) is not owned by Apache. It is hosted on a Hostinger VPS that I subscribe to. The only thing not under control is the domain name, which is easily replaced, if necessary.

Either way, imo it would be better in a place where AL are not admins and do not have the ability to remove posts. Please correct me if this is not the case anymore. What does disappoint me, though, is the complete lack of public responses anywhere on these issues, here or anwywhere.

Also, it is my understanding that a forum owner/admin would not be held liable for libel for posts made by members on that forum, and as such there is no legal duty for a forum owner/admin to proactively stop members from potentially posting libellous material. The forum owner/admin is not the publisher or speaker, and does not even have to remove such posts if requested by the post’s target. It is more of a “good Samaritan” thing I guess, but in cases where it is plainly obvious that customers are being let down, and frustration is being vented, then imo such posts should stay so that readers can decide for themselves. Just my 2p on the matter.

All that asside, the other day I spent a few hours implementing some code in Thetis (TCPipCat) that allows Laurence to direct TCP CAT messages directly to various hardware. I gather this is to be used by various modules that exist in the high power G2..... and may or may not imply something ;) ;) 8-)

It is not precisely the case, but close enough that it should not be an issue. And if it became an issue, it could rapidly be made a non-issue.

Indeed! The last time the "administrator" account (the one and only Apache Labs account that exists) was logged in here was June of 2025. The last post made by the "administrator" account was in July of 2024, 18 months ago :roll: I believe that any user can click on the administrator user name (or any user name) and see the account profile and those dates directly

In the U.S. there is some legal protection (Section 230 of the Communications Decency Act). However, since it is your's truly who would have to deal with even the most casual and "minor" law enforcement inquiries, such things are, IMHO, best avoided!
